1.Purpose

These Terms of Use, hereinafter the "Terms", set out the conditions for accessing and using the IPTV GO app.

By downloading, installing, opening or using IPTV GO, the user acknowledges having read, understood and accepted these Terms.

If the user does not accept these Terms, they must stop using the app immediately.

IPTV GO is a software application available on iPhone, iPad and Apple TV. It lets the user organise, manage and play audiovisual content from sources they add themselves.

2.Description of IPTV GO

IPTV GO is a media playback, organisation and management app.

The app may in particular allow the user to:

  • create and manage profiles;
  • add a playlist or a compatible source;
  • organise channels, movies, series or categories;
  • manage favourites, history, preferences or already-watched content;
  • play streams available from the sources added by the user;
  • enrich the display of certain content with metadata from third-party services;
  • personalise their playback experience on each of their devices.

IPTV GO is a software player and nothing more.

IPTV GO provides no audiovisual content whatsoever.

3.No content is supplied whatsoever

IPTV GO does not provide, sell, rent, distribute, broadcast or retransmit any content.

In particular, IPTV GO does not provide:

  • television channels;
  • movies;
  • series;
  • TV packages;
  • IPTV streams;
  • M3U playlists;
  • IPTV subscriptions;
  • Xtream Codes access;
  • user accounts granting access to content;
  • streaming services;
  • copyright-protected content.

Installing, purchasing or using IPTV GO grants access to no audiovisual content whatsoever.

Any payment relating to IPTV GO covers access to software features of the app only, and not access to channels, streams, playlists, movies, series or IPTV subscriptions.

The user must add their own sources themselves, under their sole responsibility.

4.Sole responsibility of the user

The user is solely responsible for the sources they add, configure or use in IPTV GO.

In particular, the user is solely responsible for:

  • the playlists they add;
  • the URLs they enter;
  • the Xtream Codes access they configure;
  • the M3U files they import;
  • the servers they connect to;
  • the credentials they use;
  • the content they view;
  • the lawfulness of the sources used;
  • compliance with copyright;
  • compliance with related rights;
  • compliance with broadcasting and retransmission rights;
  • compliance with the laws applicable in their country.

The user warrants that they hold all the rights, authorisations, licences or permissions required to access the content they view through IPTV GO.

IPTV GO does not check, validate or guarantee the lawfulness of the sources added by the user.

5.Prohibition of unlawful use

The user undertakes not to use IPTV GO to access unlawful, pirated, infringing or unauthorised content, or content that infringes the rights of third parties.

It is in particular prohibited to use IPTV GO to:

  • accessing pay channels without authorisation;
  • accessing pirated movies or series;
  • using illegal IPTV subscriptions;
  • circumventing access restrictions;
  • circumventing technical protection measures;
  • redistributing protected streams;
  • sharing or reselling unauthorised playlists;
  • infringing copyright or related rights;
  • using the app for fraudulent, abusive or unlawful purposes.

Any use of IPTV GO with an unlawful or unauthorised source is strictly prohibited.

6.User representations when adding a source

By adding a source in IPTV GO, the user represents and warrants:

  • that they are authorised to use that source;
  • that they hold the rights required to access the associated content;
  • that this source does not infringe third-party rights;
  • that they are not using IPTV GO to access pirated content;
  • that they comply with applicable laws;
  • that they alone bear the consequences of their use.

The user acknowledges that IPTV GO is not responsible for the content accessible through the sources they add themselves.

7.Offline downloads

IPTV GO lets the user download to their device content reachable from a source they added themselves, in order to play it offline.

A download creates a local copy of the content. That copy is neither provided, hosted nor distributed by IPTV GO: it comes solely from the source configured by the user.

The user is solely responsible for the lawfulness of each download. They declare that they hold the rights or permissions needed to make and keep such a copy, including under the private-copy exception where it applies.

Downloading protected content without authorisation is prohibited, whatever the source used.

Downloaded files are kept on the user's device. They can be deleted from within the app, and are removed in full when the app is uninstalled. IPTV GO keeps no copy of them.

8.TMDB metadata

IPTV GO may use The Movie Database, hereinafter "TMDB", to enrich the display of certain content with metadata, images, posters, descriptions, cast information, categories or related information.

TMDB is used solely as a metadata service.

TMDB does not supply the video content played in IPTV GO.

The use of TMDB metadata does not mean that IPTV GO provides, hosts, broadcasts or authorises access to the corresponding content.

The presence of a poster, a title, a description, a logo, a cast member or any information from TMDB does not mean that IPTV GO lawfully grants access to the film, series, channel or programme concerned.

IPTV GO is not endorsed, certified or sponsored by TMDB.

This product uses the TMDB API but is not endorsed or certified by TMDB.

TMDB data may be incomplete, incorrect, unavailable or changed at any time.

IPTV GO does not guarantee the accuracy, availability or permanence of the metadata provided by TMDB.

9.Video playback components

IPTV GO embeds LumeEngine, released under the MIT licence, which uses the FFmpeg library distributed under the LGPL licence version 2.1 or later.

FFmpeg is compiled without any GPL-licensed component. Its library is dynamically linked, and the build scripts as well as the exact version used are made available so that it can be replaced, in accordance with the LGPL licence.

VLCKit, from VideoLAN and distributed under the LGPL licence version 2.1 or later, is used exclusively for casting to an external device. It performs no local playback.

These components are technical playback building blocks. They provide no channel, no stream, no playlist, no IPTV subscription and no audiovisual content.

The use of these components in IPTV GO does not mean that their authors, in particular VideoLAN or the FFmpeg project, endorse, certify or sponsor IPTV GO.

10.No editorial control

IPTV GO exercises no editorial control over the content accessed by the user.

The app does not select, publish, host or recommend content for editorial purposes.

Any display of titles, logos, images, categories, descriptions or metadata depends on the sources configured by the user or on third-party services such as TMDB.

The presence of content in the IPTV GO interface does not mean that IPTV GO approves, validates, recommends or guarantees that content.

11.Third-party services

IPTV GO may interact with third-party services, in particular:

  • TMDB for metadata;
  • iCloud for synchronising or backing up certain user data;
  • Apple for app distribution, in-app purchases and the services tied to iOS, iPadOS and tvOS;
  • LumeEngine (FFmpeg) and VLCKit / VideoLAN for the technical video playback and casting features.
  • OpenSubtitles for subtitle search and IntroDB for locating episode intro segments;

These services are independent of IPTV GO.

IPTV GO does not guarantee:

  • their availability;
  • their stability;
  • their security;
  • their lawfulness;
  • their quality;
  • their compatibility;
  • their continuity;
  • the accuracy of their data;
  • the playback of their streams.

IPTV GO cannot be held responsible for any problem relating to a third-party service, a playlist, a server, a URL, a stream, an external source, an API or a third-party software library.

12.In-app purchases and premium features

IPTV GO may offer in-app purchases or premium features.

Such purchases relate exclusively to software features of the app.

No purchase made in IPTV GO grants access to:

  • TV channels;
  • movies;
  • series;
  • TV packages;
  • IPTV playlists;
  • video streams;
  • IPTV subscriptions;
  • audiovisual content;
  • third-party streaming services.

Payments, renewals, cancellations and refunds relating to in-app purchases are handled by Apple under the applicable App Store rules.

The Publisher cannot be held liable for any third-party IPTV subscription, external provider or content purchased outside IPTV GO.

13.Suspension or restriction of access

The Publisher reserves the right to suspend, restrict or terminate access to IPTV GO in the event of:

  • breach of these Terms;
  • manifestly unlawful use;
  • fraud;
  • infringement of third-party rights;
  • attempted technical circumvention;
  • abusive use of the app;
  • a request from a competent authority;
  • conduct liable to engage the Publisher's liability.

Such a measure may be taken without notice where the circumstances so require.

14.Intellectual property

IPTV GO, its name, logo, interface, graphics, design, code, architecture and visual elements are protected by applicable intellectual property rights.

The user holds no ownership rights over IPTV GO.

Any unauthorised reproduction, modification, extraction, adaptation or exploitation of IPTV GO is prohibited.

Trademarks, logos, names and content belonging to third parties, in particular Apple, TMDB, VideoLAN, VLC or the FFmpeg project, remain the property of their respective owners.

15.Open source licences

IPTV GO may embed open source components, in particular LumeEngine, FFmpeg and VLCKit.

Open source components remain subject to their own licences.

The user can view the applicable licences, credits and notices in the dedicated section of the app, for example under:

Settings › About › Open source licences

16.Limitation of liability

To the extent permitted by applicable law, IPTV GO and its Publisher cannot be held liable for:

  • the content accessed by the user;
  • the sources added by the user;
  • the lawfulness or unlawfulness of a playlist;
  • a third-party IPTV subscription;
  • a pirated or unauthorised stream;
  • a copyright infringement committed by the user;
  • an external source being unavailable;
  • an error or unavailability of TMDB;
  • a metadata error;
  • a malfunction of a playback component, in particular LumeEngine, FFmpeg or VLCKit;
  • iCloud being unavailable;
  • an incorrect configuration;
  • loss of local or synchronised data;
  • a malfunction related to the operating system, Apple or a third-party service;
  • any direct or indirect damage arising from use of the app;
  • any action brought against the user because of their use of the content.

The user uses IPTV GO at their own risk and under their sole responsibility.

17.Warranty and indemnification

The user agrees to indemnify and hold the Publisher harmless against any claim, complaint, action, penalty, loss, damage, cost or expense arising from:

  • their use of IPTV GO;
  • the sources they add;
  • the content they access;
  • a breach of these Terms of Use;
  • a breach of the law;
  • an infringement of third-party rights;
  • unlawful or abusive use of the app.

18.Personal data

The rules relating to personal data are set out in a separate document entitled Privacy Policy.

The user is invited to read that policy before using IPTV GO.

19.Governing law

These Terms of Use are governed by French law, unless a mandatory consumer-protection provision states otherwise.

In the event of a dispute, the user is invited to contact the Publisher first in order to seek an amicable solution.

Failing an amicable resolution, the dispute will be brought before the courts having jurisdiction under applicable law.
