1.Purpose
These Terms of Use, hereinafter the "Terms", define the conditions of access to and use of the IPTV GO application.
By downloading, installing, opening or using IPTV GO, the user acknowledges having read, understood and accepted these Terms.
If the user does not accept these Terms, they must stop using the application immediately.
IPTV GO is a software application designed for tvOS. It allows the user to organize, manage and play audiovisual content from sources they add themselves.
2.Description of IPTV GO
IPTV GO is a media playback, organization and management application.
The application may in particular allow the user to:
- create and manage profiles;
- add a compatible playlist or source;
- organize channels, movies, shows or categories;
- manage favorites, history, preferences or already-watched content;
- play streams accessible from sources added by the user;
- enrich the display of certain content with metadata from third-party services;
- personalize their playback experience on tvOS.
IPTV GO is a software player only.
IPTV GO does not provide any audiovisual content.
3.Total absence of content provision
IPTV GO does not provide, sell, rent, distribute, broadcast or retransmit any content.
In particular, IPTV GO does not provide:
- television channels;
- movies;
- TV shows;
- TV bouquets;
- IPTV streams;
- M3U playlists;
- IPTV subscriptions;
- Xtream Codes access;
- user accounts granting access to content;
- a streaming service;
- copyrighted content.
Installing, purchasing or using IPTV GO does not grant access to any audiovisual content.
Any payment related to IPTV GO concerns solely access to the application's software features, and not access to channels, streams, playlists, movies, shows or IPTV subscriptions.
The user must add their own sources themselves, under their sole responsibility.
4.Sole responsibility of the user
The user is solely responsible for the sources they add, configure or use in IPTV GO.
The user is in particular solely responsible for:
- the playlists they add;
- the URLs they enter;
- the Xtream Codes access they configure;
- the M3U files they import;
- the servers they connect to;
- the credentials they use;
- the content they view;
- the legality of the sources used;
- compliance with copyright;
- compliance with related rights;
- compliance with broadcasting and retransmission rights;
- compliance with the laws applicable in their country.
The user guarantees that they hold all rights, authorizations, licenses or permissions necessary to access the content they view through IPTV GO.
IPTV GO does not verify, validate or guarantee the legality of sources added by the user.
5.Prohibition of illegal use
The user agrees not to use IPTV GO to access illegal, pirated, infringing, unauthorized content or content that violates the rights of third parties.
In particular, it is prohibited to use IPTV GO to:
- access paid channels without authorization;
- access pirated movies or shows;
- use illegal IPTV subscriptions;
- bypass access restrictions;
- circumvent technical protection measures;
- redistribute protected streams;
- share or resell unauthorized playlists;
- infringe copyright or related rights;
- use the application for a fraudulent, abusive or unlawful purpose.
Any use of IPTV GO with an illegal or unauthorized source is strictly prohibited.
6.User declaration when adding a source
By adding a source to IPTV GO, the user declares and warrants that:
- they are authorized to use this source;
- they hold the rights necessary to access the associated content;
- this source does not infringe the rights of third parties;
- they are not using IPTV GO to access pirated content;
- they comply with applicable laws;
- they bear sole responsibility for the consequences of their use.
The user acknowledges that IPTV GO is not responsible for content accessible via sources they add themselves.
7.TMDB metadata
IPTV GO may use The Movie Database, hereinafter "TMDB", to enrich the display of certain content with metadata, images, posters, descriptions, cast information, categories or related information.
TMDB is used solely as a metadata service.
TMDB does not provide the video content played in IPTV GO.
The use of TMDB metadata does not mean that IPTV GO provides, hosts, broadcasts or authorizes access to the corresponding content.
The presence of a poster, title, description, logo, actor or information from TMDB does not mean that IPTV GO legally grants access to the movie, show, channel or program concerned.
IPTV GO is not endorsed, certified or sponsored by TMDB.
This product uses the TMDB API but is not endorsed or certified by TMDB.
TMDB data may be incomplete, incorrect, unavailable or modified at any time.
IPTV GO does not guarantee the accuracy, availability or permanence of metadata provided by TMDB.
8.VLCKit video player
IPTV GO may use VLCKit, a media library from VideoLAN, to play certain streams or video formats.
VLCKit is solely a technical media playback component.
VLCKit does not provide any channel, stream, playlist, IPTV subscription or audiovisual content.
The use of VLCKit in IPTV GO does not mean that VideoLAN endorses, certifies or sponsors IPTV GO.
IPTV GO remains solely responsible for its application, and the user remains solely responsible for the sources they add and the content they view.
9.No editorial control
IPTV GO exercises no editorial control over the content viewed by the user.
The application does not select, publish, host or recommend content for editorial purposes.
The possible display of titles, logos, images, categories, descriptions or metadata depends on the sources configured by the user or on third-party services such as TMDB.
The presence of content in the IPTV GO interface does not mean that IPTV GO approves, validates, recommends or guarantees this content.
10.Third-party services
IPTV GO may interact with third-party services, in particular:
- TMDB for metadata;
- iCloud for syncing or backing up certain user data;
- Apple for distributing the application, in-app purchases and tvOS-related services;
- VLCKit / VideoLAN for certain technical video playback features.
These services are independent of IPTV GO.
IPTV GO does not guarantee:
- their availability;
- their stability;
- their security;
- their legality;
- their quality;
- their compatibility;
- their continuity;
- the accuracy of their data;
- the playback of their streams.
IPTV GO cannot be held responsible for an issue related to a third-party service, a playlist, a server, a URL, a stream, an external source, an API or a third-party software library.
11.In-app purchases and premium features
IPTV GO may offer in-app purchases or premium features.
These purchases exclusively concern software features of the application.
No purchase made in IPTV GO grants access to:
- TV channels;
- movies;
- TV shows;
- TV bouquets;
- IPTV playlists;
- video streams;
- IPTV subscriptions;
- audiovisual content;
- third-party streaming services.
Payments, renewals, cancellations and refunds related to in-app purchases are managed by Apple according to the App Store's applicable rules.
The Publisher cannot be held responsible for a third-party IPTV subscription, an external provider or content purchased outside of IPTV GO.
12.Suspension or restriction of access
The Publisher reserves the right to suspend, restrict or terminate access to IPTV GO in the event of:
- violation of these Terms;
- clearly illegal use;
- fraud;
- infringement of third-party rights;
- an attempt at technical circumvention;
- abusive use of the application;
- a request from a competent authority;
- conduct likely to engage the Publisher's liability.
This measure may be taken without notice when the situation requires it.
13.Intellectual property
IPTV GO, its name, its logo, its interface, its graphics, its design, its code, its architecture and its visual elements are protected by applicable intellectual property rights.
The user holds no ownership rights over IPTV GO.
Any unauthorized reproduction, modification, extraction, adaptation or exploitation of IPTV GO is prohibited.
Trademarks, logos, names and content belonging to third parties, in particular Apple, TMDB, VideoLAN or VLC, remain the property of their respective owners.
14.Open source licenses
IPTV GO may include open source components, in particular VLCKit.
Open source components remain subject to their own licenses.
The user can view the applicable licenses, credits and notices in the section provided for this purpose in the application, for example under:
Settings › About › Open source licenses
15.Limitation of liability
To the extent permitted by applicable law, IPTV GO and its Publisher cannot be held liable for:
- content viewed by the user;
- sources added by the user;
- the legality or illegality of a playlist;
- a third-party IPTV subscription;
- a pirated or unauthorized stream;
- a copyright infringement committed by the user;
- the unavailability of an external source;
- an error or unavailability of TMDB;
- a metadata error;
- a malfunction of VLCKit;
- an unavailability of iCloud;
- a misconfiguration;
- a loss of local or synced data;
- a malfunction related to tvOS, Apple or a third-party service;
- a direct or indirect damage related to the use of the application;
- an action taken against the user due to their use of the content.
The user uses IPTV GO at their own risk and under their sole responsibility.
16.Warranty and indemnification
The user agrees to indemnify and hold harmless the Publisher against any claim, complaint, action, penalty, loss, damage, cost or expense resulting from:
- their use of IPTV GO;
- the sources they add;
- the content they view;
- a violation of these Terms;
- a violation of the law;
- an infringement of third-party rights;
- an illegal or abusive use of the application.
17.Personal data
The rules relating to personal data are described in a separate document entitled Privacy Policy.
The user is invited to consult this policy before using IPTV GO.
18.Applicable law
These Terms are governed by French law, unless a mandatory provision applicable to the consumer states otherwise.
In the event of a dispute, the user is invited to first contact the Publisher in order to seek an amicable solution.
Failing an amicable resolution, the dispute will be submitted to the competent courts in accordance with applicable law.
